Ipsos TouchPoints Survey Terms and Conditions of Use
By using the Ipsos TouchPoints website, the TouchPoints Diary Progressive Web Application (i.e.Online Diary) or the TouchPoints questionnaire you accept that you must abide by these Terms and Conditions along with the TouchPoints Privacy Notice.
We reserve the right to amend or change these Terms and Conditions, so please ensure you read these Terms and Conditions regularly.
Participation
By using the Online Diary you are agreeing:
- That you are aged 18 or over; or are aged 15 or over and have parental consent to participate in this research;
- That you have consented to participate in Ipsos’ TouchPoints research, to the data being collected via this TouchPoints Online Diary being used for that research and have been invited to use the TouchPoints Online Diary for the sole purpose of participating in this research;
- To these terms and conditions of use.
Responsible Membership
- As part of your participation in TouchPoints, we encourage you to participate honestly and responsibly.
- To help ensure responsible behaviour, you must NOT use this application to impersonate any person or entity, including, but not limited to, an Ipsos official, guide or host, or falsely state or otherwise misrepresent your affiliation with a person or entity.
Information
The Online Diary only collects the information you enter when completing the research diary.
The data collected via the diary is stored on Rackspace servers in the United Kingdom and EEA (European Economic Area) and by Ipsos in data centres and servers within the United Kingdom and EEA (European Economic Area).

Ownership
The TouchPoints website/ Online Diary/ TouchPoints questionnaire remain the property of Ipsos.
You must NOT make copies of the Online Diary/ Websites/ Questionnaires, give the Online Diary/ Website to someone else or try to sell them, make them available for other people to use or distribute them in any other way.
You must not remove or attempt to alter any copyright, proprietary or legal notices contained within the Online Diary/Websites. Nor are you permitted to attempt to decompile, reverse engineer or attempt to modify the Online Diary/ Websites in any way.
You can only use the Online Diary on your own personal devices. If someone else owns the devices or pays the bills for the devices, you must have permission from the owner or person who pays the bills BEFORE you install the Online Diary.
If this Online Diary is installed on a device provided by Ipsos, both the device and the Online Diary remain the property of Ipsos.
Warranties and Liability
The Online Diary / Websites and all content, functionality and features within it are provided “as is” and without warranties or representations of any kind either expressed or implied. To the greatest extent permitted by law, Ipsos disclaims all warranties of satisfactory quality and fitness for a particular purpose and that content, information displayed in or on the Online Diary/ Websites is accurate, complete, up-to-date and/or does not infringe the rights of any third party.
While we use reasonable efforts to ensure that the Online Diary/ Websites are free from viruses and other malicious code, neither we nor any other party involved in producing or delivering the Online Diary/ Websites assumes any responsibility or liability for any viruses or other malicious code that may infect your device passively as a result of downloading, installing or using the Online Diary. Except where required by applicable law, Ipsos shall not be liable to any person for any loss or damage they suffer as a result of viruses or other malicious or harmful code that they access from or via the Online Diary or Websites.
Save in respect of any liability for personal injury or death caused by our negligence, Ipsos shall not be liable for any damages, loss or injury arising in connection with these Terms and/or your use of, or the inability to use, the Online Diary/ Websites, or any function of the Online Diary/Websites, howsoever caused.
Links to other websites
The Ipsos TouchPoints website may provide links to other Websites or online resources. Because Ipsos has no control over such sites and resources, we cannot accept any responsibility or liability for those sites or resources.
We cannot guarantee the availability of such external sites or resources, nor do we endorse any content, advertising, products, cookies, website tags or other materials on or available from such sites or resources.
You acknowledge and agree that Ipsos shall not be responsible or liable, directly, or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such site or resource.
Termination
Participants are recruited to take part in the study once per annum. Participant contact details will be retained when consent has been provided and the research program has not ended/ been cancelled.
Ipsos reserves the right to refuse any participation and/or terminate participation without giving a reason.
Copyright
The TouchPoints survey and the information made available to you through the Ipsos TouchPoints website and other communications, may be protected by copyright, trademarks, service marks, patents or other proprietary rights and laws. Except as expressly authorised by Ipsos, you are not permitted to rent, lease, loan, sell, distribute, or create derivative works based on the TouchPoints survey or the Online Diary, in whole or in part.
You agree that you will not reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial purposes, any portion of the TouchPoints Survey (including your Online Diary login), any content within the TouchPoints Survey, your use of the TouchPoints survey or your access to it.
No longer wish to take part
If you no longer wish to take part in our research and have installed the TouchPoints Diary icon on your home page of your own device(s), you can remove the Online Diary from your device(s) at any time by simply deleting it from your screen as you normally would any other application.
If you no longer wish to take part in our research and this Online Diary is installed on a device provided by Ipsos, please return the device to Ipsos in the freepost envelope provided.
Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales and are subject to the exclusive jurisdiction of the courts of England and Wales.
