Ipsos TouchPoints Survey Terms and Conditions of Use

These terms and conditions (the “Terms and Conditions”) govern your participation in the Ipsos TouchPoints Survey (the “Survey”). By accessing the Ipsos TouchPoints website (https://touchpoints.ipsos.com), the TouchPoints diary progressive web application (the “Online Diary”), the TouchPoints paper diary (the “Paper Diary”), or the TouchPoints questionnaire (the “Questionnaire”), you accept that you must abide by these Terms and Conditions. Please read this document carefully before accepting it.

The Terms and Conditions are between you and Ipsos MORI UK Limited, a company registered in England and Wales with company registration number 01640855 (“we”/”us”/”our”). We have set out details of how you can contact us at the end of this document.

We reserve the right to change these Terms and Conditions from time to time (at our discretion). You will be notified of the date of the last update to the Terms and Conditions during the initial recruitment survey. If you are already taking part in the Survey, you will be notified of our updated Terms and Conditions, directly, via the Online Diary and/or via post if you are taking part using the Paper Diary. We will send you a copy of the updated Terms and Conditions to your registered email address, and you will be deemed to have accepted the updated Terms and Conditions upon your accessing of the Website, Online Diary, and/or Questionnaire.

Participation

By participating in the Survey, you agree that:

  • you are aged 16 or over and are currently living in Great Britian;
  • you consent to participate in the Survey, and to your personal data being collected (via our Website, the Online Diary, the Paper Diary, and/or the Questionnaire) for our research purposes;
  • you have been invited by us to access the Website, Online Diary, Paper Diary and/or Questionnaire for the sole purpose of participating in the Survey;
  • you will complete the Online Diary or Paper Diary during a week where you are residing in Great Britain for the entire duration of the relevant diary entry;
  • your participation in the Survey will be honest, accurate, responsible, and in accordance with any instructions we may provide to you;
  • you have received and read the Survey privacy notice (https://touchpoints.ipsos.com/privacy-notice/); and
  • you will comply with these Terms and Conditions.

Participation limits

There are two Survey waves per calendar year. The first, between January and March, and a second, between September and November. You must only take part in one wave per year, regardless of the number of invitations you may receive from us, or from one of our partners.

If you register for the Survey more than once per calendar year, we reserve the right to (in our sole discretion):

  • refuse or terminate your participation in the Survey without notice to you;
  • invalidate any of data which you have already submitted; and
  • withhold any incentive to which you may be entitled (where applicable) or the change type of incentive which may be offered to you.

Responsible Membership

As part of your participation in the Survey, we expect you to behave honestly and responsibly. You must not impersonate any person or entity, including, but not limited to, any employee or representative of ours, or any guide or host. You must not falsely state or otherwise misrepresent your affiliation with us.

We may review your Online Diary or Paper Diary entries, and/or your Questionnaire responses for authenticity. If we suspect that the information you have provided is incoherent, incomplete, invalid, automated, made using artificial intelligence tools, unrealistic, false, or otherwise unusable by us, we may require that you resubmit part, or all, of your responses in order for them to be included in the Survey and for any incentive (if applicable) to be offered to you.

If we suspect any fraudulent activity by you, we may require you to provide further information via a postal form, and/or require you to provide proof of your identity and residing address (for example, a utility bill and an official ID document). Failure to provide adequate proof of your identity may result in:

  • our refusal or termination of your participation in the Survey without notice to you;
  • our invalidation of any data you have already submitted; and
  • our withholding of any incentive to which you may be entitled (where applicable) or the type of incentive which may be offered to you.

Incentives

Voucher incentives (or if taking part as an Ipsos iris panel member the equivalent value into your iris rewards account) will be issued upon your successful completion of the Study. ‘Successful completion’ means:

  • your completion of the required elements of the Study (as instructed to you by us); and
  • your compliance with these Terms and Conditions and any other reasonable instructions we may provide to you from time to time.

We will issue incentives based on the incentive type that you selected during the recruitment process. No changes are allowed to the incentive type.

We will utilise the email and/or postal address details provided by you at the time of your recruitment to issue any incentives. We will not be held liable for:

  • Any incorrect email or postal address provided by you at the time of recruitment;
  • any codes redeemed, lost or misused after delivery to you;
  • any expired vouchers, where the expiry date was visible to you;
  • any errors associated with your handling of the vouchers;
  • any retailer or platform outages;
  • any delay in our issuing of vouchers (that is not caused by us);
  • any delay in your receiving the vouchers (that is not caused by us); or
  • any refusal by third parties to accept vouchers.

Information

The information collected in the Online Diary/Questionnaire is stored on our servers, which are managed and hosted by:

  • Rackspace Limited’s in the United Kingdom; and
  • Google Cloud Platform in the United Kingdom and Germany.

We are committed to protecting your privacy and personal data. We will not sell, rent, lend or distribute your personal information and we will only use it to facilitate your participation in the Survey. By taking part in the Survey, you confirm your consent, which was initially obtained at the recruitment stage.

Ownership

The Website, Online Diary, Paper Diary and Questionnaire remain, at all times, our property. By participating in the Survey, you agree that any information and data we collect from you in relation to the Survey will become our sole and exclusive property upon creation. You hereby irrevocably transfer and assign to us all rights, titles and interests therein and you waive all moral rights in such information and data to the extent permitted by law. You agree not to use the Survey responses, or the Website, Online Diary, Paper Diary or Questionnaire for any purpose whatsoever except as authorised by us in writing.

You must not, in relation to the Online Diary, Paper Diary, Website and/or Questionnaire:

  • make any copy or take any photograph;
  • sell, provide, publish, or otherwise distribute to a third party;
  • remove, deface, or attempt to alter any copyright, proprietary or legal notices therein;
  • decompile, reverse engineer or attempt a modification in any way.

You must only use the Online Diary, Website or Questionnaire on your own personal devices. If someone else owns the device or pays the bills for the device, you must have permission from the owner or person who pays the bills BEFORE you install the Online Diary. We shall not be held liable where you have failed to obtain the owner’s permission to use the device.

If the Online Diary is installed on a device provided by us, the device shall remain our property at all times. You shall ensure you protect and take reasonable care of our device to the same extent that you would take reasonable care of your own device. You will be liable for any loss or damage to our device.

Warranties and Liability

The Online Diary, Website and all content, functionality and features within it are provided “as is” and without warranties or representations of any kind either expressed or implied. To the greatest extent permitted by law, we disclaim all warranties of satisfactory quality and fitness for a particular purpose and that content, information displayed in or on the Online Diary and Website is accurate, complete, up-to-date and/or does not infringe the rights of any third party.

While we use reasonable efforts to ensure that the Online Diary and Website are free from viruses and other malicious code, neither we nor any other party involved in producing or delivering the Online Diary and Websites assume any responsibility or liability for any virus or other malicious code that may infect your device, passively, as a result of downloading, installing or using the Online Diary or using the Website. Except where required by applicable law, we shall not be liable to any person for any loss or damage they suffer as a result of viruses or other malicious or harmful code that they access from or via the Online Diary or Website.

We do not guarantee the availability of the Online Diary or Website. When the Online Diary or Website is unavailable, we will use our commercially reasonable endeavours to fix the issue and restore your access as soon as possible.

Save in respect of any liability for personal injury or death caused by our negligence, we shall not be liable for any damage, loss or injury arising in connection with these Terms and Conditions or your participation in the Study, howsoever caused.

Links to other websites

The Website may provide links to other websites or online resources. We have no control over such websites or resources. Therefore, we cannot accept any responsibility or liability for any websites or resource that is not owned by us.

We cannot guarantee the availability of such external websites or resources, nor do we endorse any content, advertising, products, cookies, website tags or other materials (collectively “Content”) on or available from such websites or resources.

You acknowledge and agree that we shall not be responsible or liable, directly, or indirectly, for any damage or loss caused or alleged to be caused by or in connection with your (or anyone else’s) use of or reliance on any such Content, goods or services available on or through any such website or resource.

Copyright

The Survey, and any information made available to you through the Website and other communications from us, may be protected by copyright, trademarks, service marks, patents or other proprietary rights and laws. Except as expressly authorised by us Ipsos you are not permitted to rent, lease, loan, sell, distribute, or create derivative works based on the Survey, the Website, or the Online Diary, in whole or in part.

You agree that you will not reproduce, duplicate, copy, share, sell, trade, resell or exploit for any reason whatsoever (including, but not limited to, commercial purposes), any portion of the Survey (including your Online Diary login), any content within the Survey, anything relating to your use of the Survey or your access to the Survey.

Ending your participation in the Survey

If you no longer wish to take part in the Survey and have installed the Online Diary on your device(s), you can delete it from your device as you would delete any other application.

If you no longer wish to take part in the Survey and the Online Diary is installed on our device, you must return the device to us in the freepost envelope provided, as soon as possible. If you fail to return the device to us, we will charge you the cost of replacing it.

Termination by us

You have been recruited by us, to take part in the Survey, once per calendar year. Your contact details will be retained by us, where you consent to being recontacted for the purpose of the Survey, and where our research program has not ended or been cancelled.

We reserve the right to refuse your participation and/or terminate your participation in the Survey without giving a reason or any notice to you.

Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of England and are subject to the exclusive jurisdiction of the courts of England.

General

These Terms and Conditions contain the entire agreement between us and you.

You acknowledge when agreeing to these Terms and Conditions that you do not rely on any statement, representation, assurance or warranty (whether made innocently or negligently) by us, that is not set out in these Terms and Conditions.
